This constitutes serious professional misconduct and is regarded as one of the worst offences an attorney can commit. The respondent is therefore not a fit and proper person to continue practising as an attorney. The court exercised its discretion under section 22(1)(d) of the Attorneys Act 53 of 1979 to grant the Law Society's application to strike the respondent's name off the roll of attorneys and conveyancers.
