Ratio Decidendi

The court found that several exceptions raised by the defendants were well taken. Annexure POC3, except for its first page, contained excessive and confusing evidence, rendering the particulars of claim vague and embarrassing. The plaintiff failed to properly plead amendments to loan agreements and did not adequately address Fechter's involvement and consent in the consolidation of loan agreements 2 and 3 into loan agreement 5. The later cession by Fechter did not cure the lack of consensus at the time of consolidation. Accordingly, claim A in the particulars of claim was excipiable and struck out, with the plaintiff afforded an opportunity to amend.
