Ratio Decidendi

The testimony of the plaintiff and his witness, Mr Ngwenyama, was found to be unreliable and tailored to support the plaintiff's version. The photographic and accident report evidence did not support the plaintiff's claim that the insured driver collided into his vehicle from behind. The court held that the plaintiff failed to discharge the onus of proving negligence on the part of the insured driver on a balance of probabilities. Accordingly, the plaintiff's claim was dismissed.
