Ratio Decidendi

The defendant failed to discharge the onus of proving the lawfulness of the plaintiff's arrest. No credible evidence was presented that the plaintiff was in possession of dagga, nor was the confiscated dagga or certificate of its weight produced. The defendant did not explain why the prosecution was abandoned. The arrest was arbitrary and violated the plaintiff's constitutional rights to freedom and security of the person. The plaintiff is entitled to damages for unlawful arrest, with quantum determined by reference to comparable authorities and the circumstances of the case.
