Ratio Decidendi

The registrar of the South Gauteng High Court did not have jurisdiction to issue the warrant of execution against the applicant, as the applicant resides and conducts business in the Free State Province and the cause of action arose there. Section 30M of the Pension Funds Act requires that the determination be referred to the registrar of the court with jurisdiction over the matter, which in this case is the Free State High Court. The warrant of execution issued by the South Gauteng High Court was therefore invalid and susceptible to being set aside.
