Ratio Decidendi

The court held that the Pension Funds Adjudicator is a statutory body, not a court as defined by the Constitution or the Superior Courts Act. Its determinations, although enforceable as civil judgments under section 30O of the Pension Funds Act, do not constitute orders of court for the purposes of contempt proceedings. The High Court therefore lacks jurisdiction to punish contempt of such determinations. The application for contempt was dismissed as the applicant failed to establish that the Adjudicator's determination is an order of court or that the respondents' conduct amounted to contempt of court.
