  2. 2 Whether Proclamation R32 of 2006 was valid
  3. 3 Whether the Court should confirm the High Court's order of invalidity

Ratio Decidendi

The majority held that both Proclamation R27 and Proclamation R32 were invalid because R27 mistakenly referred to the wrong sections and R32 did not clearly withdraw or validly amend the invalid proclamation in a manner that complied with legality and clarity requirements. To avoid disruption, the Court confirmed invalidity while granting just and equitable prospective relief and preserving past conduct of the Road Accident Fund for a limited period, and directing the President to issue a fresh proclamation bringing sections 1 to 5 into force from 31 July 2006.
