The principle of audi alteram partem was breached. Additionally, no Rule 16A notice was filed, despite the matter raising constitutional issues and being of public importance. The court held that these procedural defects necessitate postponement of the application to allow the applicant to comply with both Rule 6(5)(b)(iii) and Rule 16A.
