Procedural Posture

Urgent Application / Application for Bail Pending Review

  1. 1 Whether the applicant is entitled to bail pending the finalisation of review proceedings.
  2. 2 Whether the Court of Military Appeals was empowered to increase the applicant's sentence on automatic review.
  3. 3 Whether the applicant poses a flight risk or any other risk relevant to bail under section 60(4) of the Criminal Procedure Act.

Ratio Decidendi

The court found that the applicant's review application has prospects of success, as the Court of Military Appeals is generally not empowered to increase a sentence on automatic review unless the accused initiates the review or appeal. The court considered the applicant's personal circumstances, including her age and lack of flight risk, and determined that the interests of justice would be served by granting bail. The court was not satisfied that any of the grounds in section 60(4) of the Criminal Procedure Act precluded bail. Accordingly, bail was granted pending the outcome of the review application.

Court Disposition

Bail granted to the applicant pending review; no order as to costs.

Orders

  • Bail is granted to the applicant in the sum of R3000.00 (three thousand rand).
  • No order as to costs.
