Procedural Posture

Civil Application / Application to Compel Discovery of Expert Reports Prior to Trial

  1. 1 Whether the applicant is entitled to compel production of expert reports and underlying documents referenced in expert summaries under Rule 35(3) and (6).
  2. 2 Whether litigation privilege protects expert reports prepared for the purpose of litigation from disclosure.
  3. 3 Whether reference to expert reports in summaries constitutes waiver of privilege.

Ratio Decidendi

The court held that expert reports prepared for the purpose of litigation are protected by litigation privilege and are not discoverable unless privilege is waived. Mere reference to expert reports in expert summaries does not amount to waiver of privilege. Rule 36(9) requires only a summary of expert opinion and reasons, not disclosure of the full report. The applicant failed to establish that privilege was waived or that the respondent was obliged to produce the expert reports and underlying documents. Accordingly, the application to compel production was dismissed.

Court Disposition

Application to compel production of expert reports and documents dismissed with costs.

Orders

  • The application to compel compliance in terms of the Rule 35(3) and (6) notice is dismissed with costs on a party-and-party basis, including costs for two counsel (senior and junior).
  • The main action is postponed sine die to obtain a trial date from the Registrar or Judge President.
