The court held that the noting of an application for leave to appeal by the MEC suspended the operation and execution of the judgment of Ntshangase J, including the appointment of Dr Mthembu as municipal manager. The execution of the judgment by the Council and Executive Committee prior to the conclusion of the appeal process was invalid, as Rule 49(11) clearly provides for suspension unless the court orders otherwise. The conduct of the Council and Executive Committee did not amount to peremption of the MEC's right to appeal, as there was no unequivocal acquiescence by the MEC.
