Ratio Decidendi

The court found that service had not been properly effected on all respondents, including the municipality, and that only sixteen returns of service were available for thirty-eight respondents. The Sixth Respondent was not authorized to receive papers for other respondents. The court determined that the matter could not proceed until proper service was effected and all parties were given an opportunity to file supplementary affidavits and heads of argument. Directions were given for the applicant and respondents to file further papers and for the sheriff to serve the notice of set-down on all respondents, with alternative service permitted if necessary.
