Procedural Posture

Urgent Application / Interlocutory Application for Interim Attachment Order Pending Finalisation of Action

  1. 1 Whether Mercedes-Benz is entitled to an interim attachment order for the return of the vehicle pending finalisation of action.
  2. 2 Whether Mercedes-Benz validly cancelled the instalment sale agreement with Mr Coetzee.
  3. 3 Whether Mercedes-Benz is the owner of the vehicle for purposes of interim relief.

Ratio Decidendi

The court found that Mercedes-Benz had established a prima facie right to the vehicle under the instalment sale agreement, which was validly cancelled by the first summons. The ownership defence raised by Mr Coetzee was rejected as cynical and unsupported by evidence. The balance of convenience overwhelmingly favoured Mercedes-Benz, as Mr Coetzee provided no justification for continued possession and remained in substantial arrears. The National Credit Act did not preclude the granting of interim attachment orders. The conduct of Mercedes-Benz in the ex parte application, while imperfect, did not amount to egregious misconduct warranting the application of the Schlesinger principle....
