The Supreme Court of Appeal found that the second defendant's deliberate dishonesty and false factual defence significantly prolonged the trial and placed the plaintiffs at risk of an unjust outcome. The court held that this conduct warranted special costs orders against the second defendant. However, the plaintiffs' continued pursuit of the first defendant, despite clear evidence exonerating the clinic, meant they were not entitled to full costs against the second defendant. The court determined that the second defendant should pay one-fifth of the plaintiffs' and first defendant's trial costs, on the attorney and own client scale, and be deprived of one-fifth of the costs payable to him...
