Ratio Decidendi

The court found the applicants' explanation for the delay in filing their answering affidavit to be unsatisfactory and below the required standard of good cause. Nevertheless, the interests of justice demanded that the matter be adjudicated with the benefit of all relevant evidence, including the applicants' answering affidavit. Disallowing the affidavit would undermine the proper administration of justice. The court therefore granted condonation for the late filing, but ordered the applicants to pay the costs of the application due to their legal representatives' lax attitude and the respondents' justified opposition.
