Procedural Posture

Civil Appeal / Appeal From Magistrate's Court Judgment

  1. 1 Whether the Magistrate erred in awarding R150 000.00 in general damages for unlawful arrest and detention.
  2. 2 Whether the Magistrate erred in awarding interest from the date of demand instead of the date of judgment.
  3. 3 Whether the respondent's claim included detention subsequent to being remanded in custody by the court.

Ratio Decidendi

The court held that the Magistrate correctly awarded R150 000.00 in general damages for unlawful arrest and detention, considering the respondent's deprivation of liberty, loss of dignity, humiliation, emotional shock, discomfort, and contumelia. The amendment to the particulars of claim to include loss of earnings was a separate claim and its dismissal did not affect the quantum of general damages. The Minister conceded the arrest was unlawful and did not plead contributory conduct by the respondent. The court found that interest should only run from the date of judgment, as the claim was not liquidated, in line with the authority of Mabaso v National Commissioner of Police and others....

Court Disposition

Appeal dismissed with costs as to quantum; appeal upheld as to date from which interest runs. Costs apportioned to reflect partial success.

Orders

  • The appeal is dismissed with costs.
  • Interest on the amount awarded shall be at the rate of 10.25% per annum from the date of judgment in the court below.
