Procedural Posture

Urgent Application / Application to Set Aside Particulars of Claim Under Rule 30; Judgment on Merits

  1. 1 Whether an attorney admitted and enrolled in the old Transkei Division or Eastern Cape High Court, Mthatha is entitled to practice in the Eastern Cape Division, Grahamstown.
  2. 2 Whether the applicant took further steps in the proceedings with knowledge of the alleged irregularity, thereby nullifying reliance on rule 30.
  3. 3 Whether the respondent's particulars of claim complied with rule 18(10) of the Uniform Rules of Court.
