Procedural Posture

Leave to Appeal / Application for Condonation and Leave to Appeal After Judgment

  1. 1 Whether condonation should be granted for the late filing of the application for leave to appeal.
  2. 2 Whether there are reasonable prospects of success on appeal regarding the lawfulness of the arrest.
  3. 3 Whether an arrest can be lawful if the arresting officer acted on an invalid ground but objective facts support another ground.

Ratio Decidendi

The court found that while the explanation for the delay in filing the application for leave to appeal was not strong, the prospects of success on appeal warranted condonation. The central issue on appeal is whether an arrest can be lawful if the arresting officer acted on an invalid ground, but objective facts support another ground for arrest. The court held that this question was not debated during the trial and that there is a reasonable prospect that a court of appeal may find in favour of the applicant on this point. Accordingly, condonation was granted and leave to appeal to the full bench was allowed.

Court Disposition

Condonation for late filing of the application for leave to appeal is granted. Leave to appeal to the full bench of the division is granted.
