The applicant failed to follow a fair procedure before terminating the respondents' rights of residence under ESTA. The respondents had lawfully occupied the property for extended periods, paid rent, and were tolerated by the applicant for years after initial notice to vacate. The applicant did not afford the respondents an effective opportunity to make representations prior to termination, nor did it engage meaningfully as required by constitutional and statutory principles. The respondents are extremely poor, and no alternative accommodation is available.
