Ratio Decidendi

The applicant was automatically retired by operation of law upon reaching the age of 65 in terms of section 16(1)(a) of the Public Service Act. The Act does not confer a right on the employee to choose whether to retire at 65; rather, it provides for automatic retirement. Retention beyond age 65 is possible only under section 16(7), subject to specific recommendations and approvals, and for a limited period. The applicant failed to establish a prima facie right to the relief sought, and did not satisfy the requirements for urgent relief. The application was therefore dismissed.
