The Tribunal found that the merger would not result in a substantial lessening of competition in any of the relevant product or geographic markets identified. Post-merger market shares in all segments, except for Grade A office space in Cape Town CBD, remained below 15%, and even in the Cape Town CBD, the share was only 17%. The Tribunal accepted the Commission's analysis that these levels do not raise competition concerns. Furthermore, there were no public interest factors that would justify prohibiting or conditioning the merger. Accordingly, the merger was approved unconditionally.
