Ratio Decidendi

The Plaintiff failed to discharge the onus of proving that he was assaulted by the police officers. The objective evidence, including video footage, demonstrated that the Plaintiff was the aggressor and attacked Warrant Officer Last, rather than being assaulted. The Defendants proved that the arrest was justified under section 40(1)(a) and (b) of the Criminal Procedure Act, as the Plaintiff obstructed police officers in the execution of their duties and assaulted Warrant Officer Last. The confiscation of the cellphone and the use of force were justified under sections 22(b) and 27 of the Act. The Plaintiff's claim for damages was therefore dismissed.
