Procedural Posture

Review Application / Judgment on Review of Rescission Ruling

  1. 1 Whether the Commissioner properly adjudicated the rescission application in accordance with established legal principles.
  2. 2 Whether the failure to consider the applicant's explanation for default and bona fide defence rendered the rescission ruling unreasonable.
  3. 3 Whether the matter should be referred back for reconsideration by another Commissioner.

Ratio Decidendi

The Commissioner failed to properly adjudicate the rescission application by not adequately considering the applicant's explanation for default and the merits of its defence. The Commissioner focused on the condonation application rather than the requirements for rescission, which include both an acceptable explanation for default and a bona fide defence. This failure rendered the decision unreasonable and outside the band of decisions a reasonable decision maker could reach. Accordingly, the rescission ruling must be reviewed and set aside, and the matter referred back for reconsideration by another Commissioner.

Court Disposition

The rescission ruling is reviewed and set aside. The matter is referred back for the rescission ruling to be determined afresh by another Commissioner. No order as to costs.

  • The rescission ruling dated 25 April 2014 under case number LP7237/13 is reviewed and set aside.
