Procedural Posture

Urgent Application / Final Relief Application Under Section 77(3) of the BCEA

  1. 1 Whether the applicant's employment contract was breached by the first respondent.
  2. 2 Whether the applicant is entitled to specific performance of his employment contract.
  3. 3 Whether the applicant's conduct constituted repudiation of the employment contract.

Ratio Decidendi

The applicant failed to tender his services for three months without justification, despite being afforded an opportunity to explain his conduct. This constituted a material breach and repudiation of his employment contract. The Board was entitled to accept the repudiation and terminate the contract. The applicant cannot seek to enforce a contract he has repudiated. The application for specific performance is therefore dismissed. Given the lack of merit in the application, fairness demands that the applicant bear the costs.

Court Disposition

Application dismissed with costs.

Orders

  • The application is dismissed.
