The evidence before the bargaining council established that Myers had been retained in the upgraded post with increased responsibilities after his reinstatement, and the SAPS failed to provide cogent reasons for not promoting him. The arbitrator's finding that Myers was tacitly absorbed into the upgraded post and entitled to promotion was reasonable, but the retrospective effect of the award should be limited to 1 May...
