Ratio Decidendi

The arbitrator's decision to exclude the entirety of Mr Danki's viva voce evidence, despite its material relevance and partial cross-examination, constituted a gross irregularity in the conduct of the arbitration proceedings. This exclusion denied the applicants a fair hearing and prevented proper ventilation of the issues. The arbitrator failed to weigh and consider all evidence, including hearsay, as required by law. Consequently, the arbitration award was reviewable and liable to be set aside. The only appropriate remedy was to remit the matter for a fresh arbitration before a new commissioner.
