Ratio Decidendi

The court found that, although POCA provides specific provisions for rescission of restraint orders, the common law may still apply in exceptional circumstances, such as fraud, common mistake, or the discovery of new documents. The Phillips decision does not exclude common law rescission entirely. Given the facts of the case, section 26(10) of POCA, and the relevant case law, the court concluded that another court may reasonably reach a different decision regarding the rescission granted. Therefore, leave to appeal should be granted to allow the matter to be reconsidered by a higher court.
