Procedural Posture

Restraint Order Application / Return Date of Rule Nisi; Confirmation of Provisional Restraint Order

  1. 1 Whether there are reasonable grounds for believing that a confiscation order may be made against the defendant under section 25(1)(b)(ii) of POCA.
  2. 2 Whether the interim restraint order should be confirmed based on the available evidence.
  3. 3 Whether the disputed signatures on cheques were forged and whether the withdrawals constituted unlawful activity.

Ratio Decidendi

The court held that it need not be satisfied that the defendant is probably guilty or that he probably benefited from unlawful activity. It is sufficient if, on reasonable grounds, there might be a conviction and a confiscation order. The evidence showed that the defendant withdrew substantial sums from the joint venture account, with credible allegations of forgery and unauthorized withdrawals. The court found that the applicant met the statutory threshold under POCA, and the likelihood of a confiscation order is real. Accordingly, the provisional restraint order was confirmed.

Court Disposition

Provisional restraint order confirmed with costs, including costs of senior and junior counsel.

Orders

  • The provisional restraint order issued on 4 November 2005 is confirmed.
  • Costs are awarded against the defendant and respondents, including costs of senior and junior counsel.
