The Supreme Court of Appeal held that section 38 of the Prevention of Organised Crime Act (POCA) unequivocally allows the National Director of Public Prosecution to bring an ex parte application for a preservation order. The section does not require the applicant to show exceptional circumstances or a real risk of dissipation of property if notice is given. The practice directives of the Mpumalanga Division cannot override the statutory provisions of POCA or the Uniform Rules of Court. The proceedings under chapter 6 of POCA are civil in nature and are inherently urgent, justifying ex parte applications.
