Procedural Posture

Leave to Appeal / Application for Leave to Appeal Against Judgment Delivered on 8 March 2019

  1. 1 Whether the Court erred in considering irrelevant facts, creating a reasonable apprehension of bias.
  2. 2 Whether the explanation for the delay between 10 January 2018 and 11 April 2018 was inadequate.
  3. 3 Whether there was inactivity by the applicants during the relevant period.

Ratio Decidendi

The Court found that the applicants failed to address the nature of the decision under appeal and did not contend, either directly or indirectly, that the Court acted in a manner warranting interference with its discretion. The applicants did not demonstrate that the Court acted capriciously, on a wrong principle, or in a biased manner. The allegation of bias was unfounded, as the Court's reference to material outside the condonation application did not influence the outcome. The statutory test for leave to appeal was not met, as there was no reasonable prospect that another court would reach a different conclusion. Consequently, the application for leave to appeal was dismissed.

Court Disposition

Application for leave to appeal dismissed. No order as to costs.

Orders
