The Constitutional Court held that the Maximum Price Decision was a separate and independently reviewable administrative action under PAJA. NERSA’s failure to consider Sasol’s actual marginal costs and profits when setting the maximum gas price rendered its decision irrational, as it did not equitably balance the interests of the monopolist and consumers, nor did it adhere to the statutory requirements of fairness and rationality. The Court found that the methodology used—a basket of alternatives—was not rationally connected to the statutory purpose of regulating monopoly pricing and failed to address the mischief of monopolistic market power.
