The evidence of the Simpson brothers was inconsistent and unreliable, and the only unbiased witness, Mr Johnson, denied that any such statement was made. The probabilities supported the defendant's version, as it was inherently improbable that the defendant would accuse the plaintiff of theft in the presence of the plaintiff's friends and the CEO of the company, especially when the plaintiff had no control over the funds in question. The plaintiff's claim was therefore dismissed.
