The Tribunal held that locus standi under section 16(1)(b) of the Competition Act requires that the applicant be a person required to be served notice of the merger in terms of section 13A(2) and have participated in the Commission proceedings. Section 13A(2) mandates service of notice only on registered trade unions representing a substantial number of employees, or, if none exist, on employees or their representatives. Since TAWU and SATAWU together represent over 77% of KZT employees, only these unions were required to be served. The applicants, not being required recipients of notice, lack locus standi.
