The court found that Praxis had not pleaded or relied on the contract in its particulars of claim, undermining its exception. Furthermore, even if the exception were upheld, it would not dispose of the case in whole or in part, as Praxis would still need to prove the alleged oral agreement. Accordingly, Nissan was granted leave to amend its plea.
