Ratio Decidendi

The Commissioner committed a gross irregularity by failing to properly consider whether the First Applicant was served with notice of set down and by not assessing the Applicants' reasonable prospects of success in the rescission application. The evidence did not support a finding that the First Applicant received proper notice, and the Commissioner failed to consider the lack of employment relationship and the CCMA's lack of jurisdiction over dismissals arising from unprotected strike action. The rescission ruling was not one that a reasonable decision maker could reach, and the Applicants were deprived of a fair hearing. Accordingly, the rescission ruling must be reviewed and set aside.
