Ratio Decidendi

The court found that the administrator, Mr Aucamp, took irrelevant considerations into account in refusing the applicant compassionate leave to attend his mother's funeral. The applicant's conviction for a serious crime nearly 15 years ago and an incorrect classification of risk were not relevant to the decision at hand, which concerned a short, supervised absence for a funeral. The applicant had participated in rehabilitation programmes and had no recent escape attempts. Given the urgency and the lack of time to refer the matter back, the court substituted its own decision, granting the applicant permission to attend the funeral under appropriate security measures.
