Ratio Decidendi

The High Court found that the procedure adopted in the Magistrates' Court for the eviction of the Occupiers was grossly irregular and not in compliance with the requirements of PIE and the current Magistrates' Court rules. The rule nisi procedure was impermissible, and the failure to serve the founding affidavit and the court order deprived the Occupiers of their right to be heard. The cumulative effect of these irregularities justified the review and setting aside of all eviction orders granted. The court held that the eviction proceedings must be commenced afresh, following the correct procedure under PIE, and that costs should follow the result.
