The explanation for the delay was not reasonable or complete for each period, and the application failed to address prospects of success or incorporate the statement of defence by reference. The respondents were also slow to apply for condonation, only doing so after repeated demands. The court held that the application demonstrated a disregard for the rules and the principle of speedy resolution of labour disputes. Given the prejudice to the applicant, condonation was refused and costs were awarded against the respondents.
