The application was dismissed because the applicant failed to establish a prima facie right to the relief sought. The founding affidavit relied on an outdated agreement and did not identify operative provisions conferring the claimed rights. The applicant failed to provide evidence that the vehicles listed belonged to members of the company. There was a material dispute regarding Mr Nkuna's authority to represent the company, as the constitution vested such authority in the ExCo, and Mr Nkuna was not a member of the current or previous ExCo. The urgency was self-created, as the applicant had knowledge of the risk of exclusion since July 2024 but failed to pursue the earlier application....
