The applicants' attorneys knowingly enrolled an opposed matter on the unopposed roll, having been served with a valid notice to oppose and an answering affidavit. Their intention was to obtain default judgment by stealth, which constitutes a serious breach of ethical and professional standards expected of officers of the court. Such conduct goes beyond mere negligence or recklessness and amounts to deliberate deception. The court found this behaviour deserving of a punitive costs order de bonis propriis for the appearances on 21 January and 11 February 2020.
