The Court found that the delay in referring the dispute to the CCMA was excessive in the extreme and that the explanation provided by the Researchers was unsatisfactory and amounted to no explanation at all. The Commissioner failed to properly consider the lack of a reasonable explanation, the fact that the Researchers were represented by a knowledgeable union, and the absence of evidence of persistent internal attempts to resolve the dispute. The argument that the dispute was a continuing unfair labour practice was rejected as legally unfounded.
