The court found that the Commissioner committed a gross irregularity by issuing an award that was contradictory and confusing. The Commissioner initially found that the employer had proven all elements of substantive fairness, including the Third Respondent's admission of guilt and rejection of her defence. However, the Commissioner then concluded that the employer failed to prove consistent application of the rule, despite no evidence of inconsistency being raised or required. The court held that the Commissioner misunderstood the concept of inconsistency and imposed an unreasonable burden on the employer to prove the negative.
