The court held that the applicant's entitlement to ongoing commission payments after termination of the broker agreement is not supported by the Medical Schemes Act or its Regulations. The Act and Regulations require a prior written agreement for compensation, but do not create a right to ongoing payments once the agreement has terminated. Regulation 28(6) presupposes an extant agreement for ongoing services and compensation. The written agreement between the parties provided for termination on notice and did not contain any provision for ongoing commissions post-termination.
