Mr Jacobs’ mental incapacity made it impossible for him to lodge his claim or obtain curatorship timeously, so prescription did not run against him until a curatrix ad litem was appointed. The RAF Act is interpreted consistently with the Constitution and the CRPD so as to protect the affected persons from prescription.
