Ratio Decidendi

The court found that, in the interest of justice and the audi alteram partem rule, the amendment to the notice of motion should be allowed. However, the applicant brought the amendment very late in the proceedings, after the answering affidavits had been filed and the matter was ready for hearing. This late amendment caused the respondents to incur unnecessary legal costs. Therefore, while the amendment is granted, the court deviated from the normal costs order and awarded costs against the applicant for the late filing.
