Ratio Decidendi

The application for leave to appeal was dismissed because the applicant failed to set out a competent ground of review in its founding affidavit and did not supplement its case appropriately. The alleged gross irregularity regarding the lack of an oral hearing was not pleaded as a ground of review and cannot be considered solely on argument. The Labour Appeal Court's decision in Comtech is binding and precludes the court from considering non-pleaded grounds of review. The court found no reasonable prospect that another court would reach a different conclusion. The late filing of submissions was condoned as the application for condonation was not opposed and good cause was shown.
