The court held that Rule 14.4.2 of the GEPF Rules requires the Board to act on the advice of its actuary and to consult with the Minister and employee organisations when determining actuarial factors. However, consultation in this context means discussion, not agreement, and may occur either before or after the decision is made. The Board is not obliged to accept input from consultees. The evidence showed that both the Minister and employee organisations were consulted and acquiesced to the changes, and the applicants were represented during the relevant meetings. The court found that the requirements of Rule 14.4.2 were satisfied and that the application for review could not succeed.
