The Supreme Court of Appeal held that section 46(2) of the National Land Transport Act does not apply to disputes arising from negotiations for new contracts under section 41. Section 41 governs the conclusion of new negotiated contracts by municipalities for integrated public transport networks and does not provide for mediation or arbitration of disputes arising from such negotiations. Section 46 applies only to existing contracts as defined in the Transition Act, and its dispute resolution mechanism is limited to amendments or inclusion in integrated networks for those contracts.
