  1. 1 Whether the plaintiff and defendant concluded an oral agreement on 31 August 2006 for the defendant to perform work on the left engine of the aircraft.
  2. 2 Whether the plaintiff, acting pursuant to the agreement, entrusted the aircraft to the defendant or its agent to carry out the work.
  3. 3 Whether the agent, while acting in such capacity, performed work on the left engine of the aircraft on 31 August 2006.

Ratio Decidendi

The court found, on the balance of probabilities and considering the totality of the evidence, that an oral agreement existed between the plaintiff and defendant for the defendant to perform maintenance work on the left engine of the aircraft on 31 August 2006. The plaintiff entrusted the aircraft to the defendant, who acted through its agent, Mr Handares, to carry out the work. The objective probabilities and the ongoing AMO relationship supported the plaintiff's version. All separated issues were answered in the affirmative in favour of the plaintiff.

Court Disposition

All separated issues are answered in the affirmative in favour of the plaintiff. Costs awarded to the plaintiff.
