Procedural Posture

Review Application / Judgment

  1. 1 Whether the commissioner was entitled to substitute the employer's sanction with his own.
  2. 2 Whether the dismissal of the third respondent was procedurally and substantively fair.
  3. 3 Whether the commissioner exceeded his powers in awarding compensation.

Ratio Decidendi

The court held that the commissioner, having found the dismissal to be for a serious and dismissable offence and that the rule was reasonable and lawful, was not entitled to substitute his own sanction unless the dismissal was found to be unfair. Since the commissioner did not find the dismissal to be unfair, his substitution of the sanction and award of compensation exceeded his powers. The review succeeded and the commissioner's award was set aside and replaced with a dismissal of the application.

Court Disposition

Review succeeded; commissioner's award set aside and application dismissed.

Orders

  • The review succeeds and the order of the commissioner is set aside and substituted with: 'The application is dismissed.'
  • No order as to costs.
